Pre-Removal Risk Assessment
Individuals who believe that they are in danger of their safety or lives if they are to return to their native country may apply for a Pre – Removal Risk Assessment (PRRA) made available only to applicants in Canada who are under a removal order. The basis in which the assessment considers the PRRA is the same of the refugee claim which is derived from the definition of the Convention refugee, risk of torture, and risk of life or of cruel and unusual treatment or punishment. The difference however between the refugee claim and the PRRA is that the applicants have no rights to a trial, due to it being intended as an expedited process. The candidate must then make certain that the application is appropriately documented and all legal submissions in support of the case are obtained in writing. Persons who are found to be at risk under this category may apply for permanent residence in Canada.
